These terms govern your use of Benchmark ("the Service"), a construction business operating system for solo operators and small residential contractors. By creating an account or using the Service, you agree to these terms.

1. Accounts

You must provide accurate information when you register. You are responsible for safeguarding your password and for any activity that occurs under your account.

2. Subscription and Payment

Benchmark is offered on a subscription basis. Fees are billed in advance and are non-refundable except as required by law. You may cancel at any time; cancellation takes effect at the end of the current billing period.

3. Your Data

You retain ownership of all data you put into Benchmark — clients, projects, estimates, invoices, financial records. We store this data to provide the Service and will not sell it. You can export your data at any time.

4. Financial Information

The Service provides tools for tracking estimates, invoices, payments, and profit distribution. It is not a substitute for professional accounting, tax, or legal advice. You are responsible for the accuracy of your own records and for filing any required reports or tax returns.

5. Acceptable Use

You will not: (a) use the Service for anything illegal; (b) attempt to gain unauthorized access to other accounts or to our systems; (c) resell or white-label the Service without written permission; (d) misuse the Service in a way that interferes with other users.

6. Disclaimer of Warranties

The Service is provided "as is" without warranty of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that the data will always be available.

7. Limitation of Liability

To the maximum extent permitted by law, Benchmark shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.

8. Changes

We may update these terms from time to time. Material changes will be communicated by email or in the app before they take effect.
